New H-1B Memo Employers Need To Know
On January 8, 2010, USCIS issued a new memorandum regarding H-1B employer sponsorships for specialty occupation workers. Many employers of H-1B professionals are IT consulting firms that send employees to client’s work site for contract purposes. The new memorandum sought to clarify qualifying employer/employee relationship and change the requirement in which an employer can show that it has control over the qualifying employee.
Based on USCIS’s memorandum, some employers do not meet the requisite requirements to sponsor for employee if they do no have manage and control over the employee day to day activities. For example, if your company is an IT consulting firm, whose primary purpose is to place employee as contractor, then your organization function more like a staffing company, verses a consulting firm. If, however, your company place a team of staffs into a client’s site for a specific project, and that your employee reports to your company on a regular basis, you may be qualified.
